The company which administers the website www.vestherm.ro, hereinafter referred to as Vestherm, is SC Vestherm SRL

Using this site implies acceptance of the terms and conditions below. We recommend reading these carefully. SC Vestherm SRL assumes the right to modify these provisions without further notification. The latest version can be found by accessing the "Terms of Use" page at the bottom of the website pages.

1. Data confidentiality

Accessing the Vestherm.ro site implies the users' acceptance that their personal data will be stored and processed by SC Vestherm SRL, a company registered in the register of personal data processing under number 21972. The purposes of processing this data are: creating a database for making marketing reports, information about Vestherm promotions or about any other promotions or activities carried out by Vestherm through any means of communication (mail, e-mail, telephone, SMS, etc.). SC Vestherm SRL undertakes the fact that personal data will not be disseminated to third parties, with the exception of the direct marketing operator (At the moment the E-send service is used). Your personal data may be transmitted to the legal authorities for the purpose of verifying commercial transactions or other legal authorities for carrying out any checks, if this will be requested in accordance with the laws in force.

SC Vestherm SRL certifies the fact that it will respect the rights conferred by the Law no. 677/2001 regarding the protection of individuals regarding the processing of personal data and the free movement of such data, of the Law no. 365/2002 regarding electronic commerce, as well as Ordinance no. 130/2000 regarding consumer protection when concluding and executing distance contracts with subsequent amendments.

2. Copyrights

The entire content of the website www.vestherm.ro, consisting of images, texts, graphics, symbols, web graphic elements, scripts, programs and other data is the property of SC Vestherm SRL and its suppliers and is protected by the Copyright Law and the laws regarding intellectual and industrial property. The use without the written consent of SC Vestherm SRL of any of the elements listed above is punishable according to the laws in force. 3. Access to information on the website

SC Vestherm SRL guarantees all users limited access, in personal interest, to the website www.vestherm.ro SC Vestherm SRL does not grant users the right to download, partially or fully modify the site, to partially or fully reproduce the site - to copy, sell/resell or exploit the site in any other way, for commercial purposes or contrary to the interests of SC Vestherm SRL without its prior written consent.

Vestherm does not offer any guarantee expressly or implicitly and in its own name or in the name of other persons, regarding the products presented and offered for sale. This clause applies including, but not limited to, the operation of this site, for: the information, content, materials or products on the site, as well as their suitability for a certain purpose. Users expressly agree that using this site and purchasing products or services is at their own risk. SC Vestherm SRL cannot guarantee the availability in stock of all the products presented, this fact being the responsibility of its suppliers of products and services, for which SC Vestherm SRL acts as an intermediary.

The images published on the website have the title of example, and the delivered products can sometimes differ from the images presented in any way (color, accessories, appearance, etc.). SC Vestherm SRL and its suppliers reserve the right to modify the technical specifications of the products without prior notification. The content of the site (texts, product descriptions, technical characteristics, images, symbols) is compiled in close collaboration with the representatives of the respective brands in Romania. For this reason, SC Vestherm SRL does not assume responsibility for the product descriptions presented on the SC Vestherm SRL website, these being identical to those made available to us by the representatives of each brand.

SC Vestherm SRL is not responsible for possible defects of products purchased through its own sales network. All responsibility for these defects and their repair rests with the importer/supplier or the service authorized by him, as stipulated in the warranty certificate that accompanies the purchased product(s). All products are accompanied by the original warranty certificate issued by the importer or supplier. The maximum amount of damages that can be paid by SC Vestherm SRL to any customer in case of non-delivery or improper delivery is the amount collected by SC Vestherm SRL from this customer.

6. Limitation of liability for prices

The prices presented include VAT (at the percentage established by the applicable legislation), but do not include delivery costs, unless this is expressly specified on the website.

If several promotions are applied to one or more products at the same time (discounts, gifts, promotional packages, etc.) ONLY ONE PROMOTION APPLIES - THE ONE WITH THE HIGHEST VALUE at the time of purchase by the customer of this / these product(s).

7. Limitation of liability for delivery

The delivery of the products has a national expansion area and, thus, will be done anywhere in Romania. In addition to the fee charged by SC Vestherm SRL for products or services, the customer will be required to pay a delivery fee paid directly to the courier company that transports the products.

SC Vestherm SRL cannot be held responsible for delays or cancellations of deliveries of ordered products, if they are caused by reasons beyond the control of SC Vestherm SRL, which include: fires, explosions, floods, epidemics, strikes, government actions, wars, acts of terrorism, protests, riots, civil disturbances or other impediments of force majeure, according to the provisions of Romanian legislation applicable and in force at the time of confirmation of the order. If the customer is not found at the mentioned address, within the time interval established by mutual agreement, the product / products that are the subject of this delivery can be handed over to the customer only after the reconfirmation of the order by a sales consultant and after payment of any additional costs generated by this situation.

8. Limitation of liability for payment

Payment for the products ordered according to this Customer Agreement can be made in advance or upon delivery of the products. SC Vestherm SRL reserves the right to request payment of products in advance in certain cases. Advance payment can be made by postal order, payment order or by cash deposit in the company's account; proof of payment must be sent to SC Vestherm SRL at the e-mail address office@vestherm.ro. The delivery will be made only after the money has entered the account of SC Vestherm SRL. Payment in advance is also considered payment with the help of the online credit card, by selecting the online payment processor in the order form. In this case, SC Vestherm SRL will ask the electronic payment processor to confirm the security and validity of the transaction and will also perform additional checks where necessary, before delivering the products. The ordered products must be paid in full; otherwise the delivery will not be made.

In the case of paying for the products upon delivery through the refund procedure, in addition to the price of the product and that of the transport, the counter value of the refund service will also be paid. For more details, consult the website of the courier company: Urgent Courier. In order to save the cost of the refund, payment can be made by payment order or payment.

9. Limitation of liability for product warranty

The products bought through this site benefit from the warranty practiced by the supplier of each individual brand, in compliance with the legal provisions in force. Thus, each product will be accompanied by the manufacturer's warranty certificate, which directly or through its representatives provides service for the respective product. The responsibility for any situations involving the malfunctioning, non-functioning of the product or its non-compliance with the characteristics of other products in its family belongs exclusively to the supplier / importer of these products, in accordance with the Romanian legislation in force.

10. Limitation of liability for user comments

Users who visit the website www.vestherm.ro can make comments about it and the products it offers, which can be published on the website after prior approval. SC Vestherm SRL reserves the right not to publish on the site comments with illegal, obscene, threatening, defamatory content, which in any way disturbs the private life of other people, violates intellectual property rights, contain viruses, texts regarding various promotional campaigns, chain letters, mass emails or any other form of spam.

SC Vestherm SRL will not bear the responsibility and will not be obliged to pay any kind of compensation for any form of damage caused by such comments or communications. In case of sending some materials/documents, other than those related to the process of buying/selling some products, it is considered that the user grants SC Vestherm SRL and its affiliates/associates the non-exclusive, unlimited, free, irrevocable and re-transmissible right to use them, reproduce, modify, adapt, publish, translate, as well as the right to distribute it anywhere in the world, by any means.

The user guarantees that he has all the rights to the content he transmits to be published on the site, by any means, so that, by using this content, he does not cause harm to any person. SC Vestherm SRL does not assume any responsibility for possible damages caused by the use of the content of these comments by website users, they being offered under the same limitation of responsibility as the rest of the content on the website.

11. Limitation of responsibility for links to other sites, server, browser

The SC Vestherm SRL website is hosted by the servers of a third party be it physical or legal, the right to use the space on the server and to use the related services being acquired according to the law. SC Vestherm SRL cannot be held responsible for any errors that may appear on the site, regardless of the reasons for their appearance, including changes to the site, settings, or updates. SC Vestherm SRL cannot be held responsible for errors that occur due to the use of certain browsers to visit the SC Vestherm SRL website.

SC Vestherm SRL is not responsible for the content, quality or nature of the sites that can be accessed via links from the Vestherm.ro website. For the respective sites, full responsibility is borne by the owners of the sites in question. SC Vestherm SRL assumes responsibility towards its clients to do all the diligence to limit or interrupt access to sites that, by the nature of the published information, contravene Romanian laws, but cannot be held responsible for violations of the law by these sites.

12. The right to return the products

The customer has the right to notify SC Vestherm SRL in writing that he renounces the purchase, without penalties and without citing a reason, within 10 working days from the receipt of the product or, in the case of services, from the conclusion of the contract, by returning this term of the product purchased in the original packaging, the customer bearing the shipping costs according to the Romanian laws.

Any such request / notification will be given, signed and sent by the person registered in the database by e-mail to the address office@vestherm.ro.

13. Disputes and final dispositions

Any other problem caused by the products and services presented on www.vestherm.ro or by the information presented on this site and which is not already covered by any article in this document, will be resolved amicably within 30 working days from on the date of written notification of the problems by the user. In the event that it was not possible to resolve the conflict amicably, the competence rests with the Romanian courts within the radius of the municipality of Piatra Neamt. The customer fully assumes these risks once he expresses his agreement to this Customer Agreement. The agreement can be expressed both expressly, through its unequivocal communication, in any way, to the representatives of SC Vestherm SRL, as well as tacitly, through the purchase of a product / products.
